With the judgment passed by the Kazakhstan Supreme Court on May 8, 2007 the land of the Hare Krishna community in Almaty province may be confiscated in favor of the government at any moment।

The Supreme Court reversed its own judgment made on June 30, 2005, which had enabled the community to use 116 acres (48 hectares) of land and receive the right of ownership after processing respective documents by the registering bodies of the Karasai district। These bodies have never registered the plots in favor of the Religious Organization Society for Krishna Consciousness (ISKCON) because the land was withheld by the Karasai District Court at the request of the local Hakim.

The local ISKCON chairperson told the Panel of the Supreme Court that they had never been informed of the proceedings or the decisions of the lower courts।

The ISKCON chairperson requested the court to postpone the hearing as she needed time to study the case and consult lawyers। However, the court decided to conduct the hearing immediately and only gave her a few hours to study the lower court rulings. Thus the defendant was left without legal protection, unable to retain an attorney.

During the hearing she again demanded that the court session should be postponed for her to have time to retain an attorney and properly study the case. However, the Civil Panel of the Supreme Court dismissed this motion and decided to reverse its own judgment of June 30, 2005, which had given the right of land use to the Society for Krishna Consciousness.
The judgment of the Supreme Court came into force from the moment it was read। It means that at any moment the land of the main centre of the Society for Krishna Consciousness can be confiscated and transferred to the Karasai district land reserve.

The conflict around the community has been going on since 2004. At that time the administration of the Karasai district started a series of trials against the members of the Hare Krishna community. As a result of these trials, 13 homes were demolished last November.
In March of 2007 the government of Kazakhstan showed an intention to resolve the conflict by way of negotiation with the community and declared the situation to be the result of bad governance of the local authorities। However, to the present moment no practical steps have been taken by the government to resolve the situation.

Thirteen more devotee houses may be demolished at any moment। With this court judgment, any day they may be forced to vacate the land wherein the Society is registered. Fifty devotees and 30 cows will be left without a roof, their temple will cease to exist, and the loss of the legal address actually means that the Society for Krishna Consciousness will be liquidated in Almaty province.

Demolition of 13 houses in the Hare Krishna community of the Karasai district, Almaty province, appointed for May 4, 2007, was stopped.

At 10 a.m. bailiffs of the Karasai district confirmed by telephone to the leaders of the Society for Krishna Consciousness that they are coming to execute the court ruling. After a little while electricity was disconnected from the community housing area.

Observers from OSCE and the US Embassy, as well as media people, then came to the demolition spot.

The bailiffs said that the request of the leaders of the Society for Krishna Consciousness to cancel the demolition in view of expected negotiations on the situation around the community can not be a good reason for the cancelling. The demolition will take place, said the bailiffs, because the Karasai Hakimat requires immediate execution of the court rulings.

The community leaders straightway informed of the situation the General Prosecutor’s office, the President’s Administration, and the Religious Committee.

Lyudmila Danilenko, an officer of the Religious Committee, said on behalf of the chairman of the Committee Yeraly Tugzhanov that the issue of the community is indeed under negotiation. Also she said that the Committee is interested to know who initiated the demolition, since there is an agreement that no force can be used until the conflict remains unresolved.

The Hakimat of Almaty province replied to the Religious Committee that they did not give any orders for demolition.

The Karasai Hakimat also found it difficult to say who had given the order to demolish the Hare Krishna’s houses.

Representatives of the General Prosecutor’s office addressed the same question to the President’s Administration, however the Administration failed to answer who supervises the issue of the Hare Krishna community.

Then electricity was turned on. The bailiffs did not come, and the demolition did not take place.

Dear Arizona Attorney General

I am writing to you to protest the impunity regarding the protection of environmental space for all citizens and persons in the Jurisdiction of Arizona.

I am in FLAGSTAFF AZ now at 6:36 pm 5-05-07.
The air is chemically contaminated.

I have no clean air, no clean water, and no clean housing. The remaining population are being marginalized.

You are a SWORN OFFICIAL ENTRUSTED WITH PROTECTING THE CONSTITUTION AND NATURAL PERSONS OF THE STATE OF ARIZONA.

As such you have no legal or moral grounds for not taking action.

The Governor should declare a STATE OF EMERGENCY REGARDING A CHEMICAL SPILL.
I do not consider you or Governor Napolitano as working in a de jure or legal manner.
I also do not believe that either you or Governor Napolitano can use the federal government as a scapegoat.

AS CODE OFFICER OF THE STATE OF ARIZONA, YOUR LEADERSIP IS GOING TO BE A STAIN ON WHAT IS IN REALITY A WESTERN MYTHOLOGY CONCERNING THE SETTLING OF THE STATE AND WEST. YOU HAVE TO TAKE ACTION.

I DO NOT USE DRUGS AND HAVE A COMPETENT ACADEMIC RECORD. THE USE OF THE CONTRABAND AS SMOKING POT IS AN INSULT TO ME AND SHOULD BE TO YOU ALSO. THE ELEMENT OF THE POPULATION ARE ONLY A MARGINAL SECTOR OF THE POPULATION THAT ARE CAUSING TROUBLE.

I HAVE NO USE FOR THE SUBSTANCE WHATSOEVER.

Another component of this degradation is the use of profiling.

I am not a biker-gang member-drug dealer. I am not LGBT. This is the profile that is the foil in the attack on the Constitution and natural population.

My right to worship my faith is also a catalyst to bait and switch the population against the criminal and civil code of Arizona.

I do not support euthanasia, drug or alcohol use.

I am serious student of Human Rights and academically file memos regarding these events to leading figures in the Administration of Justice as Adriane Raine, Robert Hare, and John Jay School of Criminology.

Indirectly I urge you to start to advocate the conversion of serious Part II misdemeanors as assault to felonies and use a Three Strike Law on violent felons.

13-305. Criminal liability of enterprises; definitions

A. Notwithstanding any other provisions of law, an enterprise commits an offense if:
1. The conduct constituting the offense consists of a failure to discharge a specific duty imposed by law; or
2. The conduct undertaken in behalf of the enterprise and constituting the offense is engaged in, authorized, solicited, commanded or recklessly tolerated by the directors of the enterprise in any manner or by a high managerial agent acting within the scope of employment; or
3. The conduct constituting the offense is engaged in by an agent of the enterprise while acting within the scope of employment and in behalf of the enterprise; and
(a) The offense is a misdemeanor or petty offense; or
(b) The offense is defined by a statute which imposes criminal liability on an enterprise.
B. As used in this section:
1. "Agent" means any officer, director, employee of an enterprise or any other person who is authorized to act in behalf of the enterprise.
2. "High managerial agent" means an officer of an enterprise or any other agent in a position of comparable authority with respect to the formulation of enterprise policy.
